We may terminate the use of the Trimoji solution at any time in writing if you violate our rules. However, before any termination on our initiative, we will send you a 30-day notice to allow you to rectify the situation, except in cases of severe violations of our terms, such as fraud or repeated non-payment. TEAMBUILDR, at its sole discretion, may decide to withdraw all or part of your access if the situation is not rectified within this 30-day period.

In the event of termination, you agree not to use the application.

Termination Conditions and Amount Due:

If the Client terminates the subscription before the end of the contractual commitment (and within the first 12 months of the subscription), for a reason not covered by free termination clauses, they will have to pay the difference between the committed offer and the non-committed offer, per user and per month, for the period of use of TEAMBUILDR SAS Solutions.

Example 1: Termination After 5 Months of Subscription

The Client, having subscribed to the Trimoji Start offer (€100 excluding VAT per month) from TEAMBUILDR SAS for 1 user with a 12-month commitment, decides to terminate the subscription after 5 months for a reason not covered by free termination clauses. The amounts due would be as follows:

Start Offer:

With commitment: €100 excluding VAT per month for 5 months = €500 excluding VAT
Without commitment: €200 excluding VAT per month for 5 months = €1,000 excluding VAT
Amount due: €1,000 - €500 = €500 excluding VAT

The Client will have to pay €500 excluding VAT to terminate after 5 months of subscription.

Example 2: Termination of a Subscription Longer than 1 Year (2-Year Commitment)

If the Client has subscribed to a 2-year commitment for the Pro offer (€300 excluding VAT per month per user) and decides to terminate in February of the second year (after 18 months of subscription), the amount to pay for exiting the contract would be calculated as follows:

Step 1: Calculate the remaining months of commitment:
2-year commitment (24 months) – Elapsed period (18 months) = 6 remaining months
Step 2: Calculate the remaining amount due for termination:
50% of the remaining amount to be paid (for the 6 remaining months of the contract)
So, 50% x €300 x 6 months = €900 excluding VAT

The Client will have to pay €900 excluding VAT to terminate the subscription after 18 months of a 24-month commitment.

Example 3: Termination of a Subscription Longer than 1 Year (3-Year Commitment)

If the Client has subscribed to a 3-year commitment for the Pro offer (€300 excluding VAT per month per user) and decides to terminate in February of the second year (after 18 months of subscription), the amount to pay for exiting the contract would be calculated as follows:

Step 1: Calculate the remaining months of commitment:
3-year commitment (36 months) – Elapsed period (18 months) = 18 remaining months
Step 2: Calculate the remaining amount due for termination:
50% of the remaining amount to be paid (for the 18 remaining months of the contract)
So, 50% x €300 x 18 months = €5,400 excluding VAT

The Client will have to pay €5,400 excluding VAT to terminate the subscription after 18 months of a 3-year commitment.

Data Return and Deletion:

In the event of subscription termination, the Client may request the return or deletion of their personal data. This request must be made by email to rgpd@teambuildr.fr. The company undertakes to delete the data within a reasonable period, in accordance with the provisions of the General Data Protection Regulation (GDPR). The data will also be deleted after termination unless legal or contractual obligations require their retention.

Right of Opposition and Deletion:

You have the right to object, meaning the right to ask us not to use your data for marketing purposes. We will inform you (before collecting the data) if we intend to use your data for this purpose or provide it to a third party or partner. You can exercise this right at any time by contacting us via contact@trimoji.fr.

You also have the right to deletion. Upon simple request by email to rgpd@teambuildr.fr, you can obtain the complete deletion of your collected data.
